iMemories Inc. (“iMemories”, “we”, “our”, or “us”) has created this Privacy Policy (“Privacy Policy”) because we know that you can about how information you provide to us is used and shared. This Privacy Policy describes the information collection and use practices of iMemories in connection with all the websites owned or controlled by iMemories, including but not limited to the website located at https://www.imemories.com (collectively, the “Websites” and each, a “Website”), our web-based, mobile and TV apps (collectively, the “Apps” and each, a “App”), our products and services made available through the Websites and the Apps (collectively, the “Services”), and when you otherwise interact with us in any way.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Websites, Apps and Services.

By visiting any of our Website, accessing and/or using our Apps and/or Services, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Service.

What information do you collect about you and how do we collect it?

We may collect several types of information from and about users of our Websites, Apps and/or Services, including information by which you may be personally identified, such as a name, physical address, or email; information that is about you but individually does not identify you; and information about your internet connection, the equipment you use to access the Websites, Apps and/or Services, and usage details. We collect this information directly when you provide it to us, automatically as you navigate through Websites, Apps and/or Services, which includes usage details and other information collected through cookies and web beacons, and from third parties, for example, our business partners or other users.

We collect personal information and other information from you when you interact with us, such as when you mail or upload your home videos and photos to iMemories; when you register for an account and use our Websites, Apps and/or Services, or place an order for products or subscribe to a service; when you contact our customer service representatives; or when you respond to a survey or enter a contest or sweepstakes that we administer. This information may include some or all of the following:

• Your name
• Your physical address
• Your email address
• Your telephone number(s)
• Credit card and other payment information
• Any other identifier by which you may be contacted online or offline
• Your home videos, photos and other content that you send to iMemories and/or upload to the iMemories Site ("Your Content").

In order to purchase our Services, you will be required to provide certain additional information which may include a credit card number, expiration date, billing zip code, activation code, bank information, and similar information (“Billing Information”). Such Billing Information will be collected and processed by our third party payment processor pursuant to the terms and conditions of their privacy policies and terms of use. We do not directly obtain, store or process any Billing Information.

You may provide third parties access to Your Content on the Websites, Apps and/or Services. Your Content is posted on and transmitted to others at your own risk. Although you may set certain privacy settings for which third parties may view Your Content, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Websites, Apps and/or Services with whom you may choose to share Your Content. Therefore, we cannot and do not guarantee that Your Content will not be viewed by unauthorized persons.

Information You Provide About Others.

If you choose to share Your Content with someone else through any feature made available through our Websites, Apps and/or Services, we will use the personal information you provide (for example the e-mail address of the recipient) to fulfill your request and for other purposes described in this Privacy Policy. Please be aware that your name and/or email address could be provided to us by another user of the Websites, Apps and/or Services for the same purpose.

Information from Social Networking and Third Party Services

Our Websites, Apps and/or Services may allow you to interact with or through social networking services such as Facebook, Twitter and Instagram (“Social Features”). Examples of Social Features include enabling you to “like” or “share” content or to log into our Websites, Apps and/or Services using your username and password for the third-party social network. If you choose to connect your iMemories account with a third-party social network, the social network may share information about you with us such as your public profile, e-mail address and friend list. If you choose to “like” or share content, information about you may be publicly displayed on the social network. You should review the privacy policy of that third-party social network and check your privacy settings through that social network. If you post information on a social networking or other third-party service that references iMemories or its products or services (e.g., via a Twitter hashtag), we may publish your post on our Websites, Apps and/or Services.

Information from Automatic Data Collection Technologies

As you navigate through and interact with our Websites, Apps and/or Services, we may use automatic data collection technologies to collect certain technical information from your computer or mobile device over time and across different websites, such as what type of browser you are using, the website from which you enter the Websites, Apps and/or Services, and the pages and content you view and / or select as you tour our site.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Websites, Apps and/or Services and to deliver a better and more personalized service, including by enabling us to estimate audience size and usage patterns, store information about your preferences allowing customized Websites, Apps and/or Services, speed up your searches, and recognize you when you return to our Websites, Apps and/or Services. We and our service providers use this information in connection with iMemories marketing programs and to improve our website design and content.

How does iMemories use and share your information?

We may use and share your personal information for the following purposes:

• If you redeem an offer or order products and services from iMemories in connection with a co-branded promotion we conduct in partnership with another retailer, we may share the information you provide at that time with our retail partner. • We may also share your personal information with third parties who provide services to us such as helping us fulfill customer orders, process credit card orders and the like. We will take reasonable measures (e.g., by contract) to require that any party receiving any of your personal information from us, including for purposes of providing the Services, undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your personal information except with your consent, as permitted by applicable law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your personal information.

How does iMemories protect the privacy of my information, including my videos and photos?

The security of your personal information is important to us. We have implemented an information security program that contains administrative, technical and physical controls that are designed to reasonably safeguard personal information. These safeguards include firewalls and the use of Transport Layer Security (TLS) to encrypt pages when collecting or transmitting sensitive information such as your password or credit card information. The safety and security of your information also depends on you. We urge you to be careful about giving out information in any public areas of the Websites, Apps and Services. Although we do our best to protect your personal information, unfortunately, the transmission of information via the internet is not completely secure. We cannot guarantee the security of your personal information transmitted to any Website, App and/or Services. Any transmission of personal information is at your own risk.

We are not responsible for circumvention of any privacy settings or security measures contained on our Websites, Apps and Services.

We do not make Your Content publicly accessible, except as directed by you or as otherwise noted in this Privacy Policy. We do not use Your Content to train our artificial intelligence or machine learning models. Please be aware that, in order to provide quality products, the iMemories employees and agents who work to digitize Your Content, fulfill your order or provide you with customer support may see your home videos and photos in the course of performing their jobs.

iMemories is designed so that you can control who may view Your Content. Sharing your home videos and/or photos electronically through iMemories is one of the key benefits we offer. Please note that if you choose to post a link to your iMemories home videos and photos on your own or others' websites, or if you share your photos with your friends or family members and they post your share invitation on a Web site or forward to other individuals, these home videos and photos may be made accessible to others who view the e-mail invitation or visit these Web sites. Be sure to make your wishes known to those you share Your Content with.

What choices do I have about your use of my personal information?

The goal of our marketing and promotional efforts is to inform you about our products and services, including special promotions, that may be of interest to you. We may use your contact information to inform you of offers. However, if you are contacted and do not wish to receive further marketing communications, use the means by which you were contacted to let us know. If contacted by postal mail, return the mail to the sender. If contacted by e-mail, reply to the e-mail sender or use the unsubscribe mechanism within the email. You may also unsubscribe to certain types of notifications through your account “Profile” settings on the Websites, Apps and the Services.

We will act promptly to honor your request and remove your name from the sender's marketing list. However, even if we remove your name from use in marketing programs, you may still receive communications from the sender for non-marketing purposes, for example in connection with a pending order or customer service issue.

How can I review and update the personal information you have about me?

If you would like to review, correct or delete your personal information, you may be able to do so by logging into your account on the Website, the App and/or the Services. Alternatively, you may contact us at the contact information below. There may be times when we are unable to fulfill your request - for example, if providing access to your personal information would reveal confidential commercial or proprietary information or personal information about someone else (and we cannot separate your data), if we are prohibited by law from disclosing the information or if we have a legal obligation to retain certain data. We may require additional personal information from you for the purposes of verifying your identity and rights.

Exporting your moments: Looking to back up or share your videos and photos outside of iMemories? You have two options:

1. Download: Navigate to 'Albums' and tap select on the upper right menu. Select the Albums you want to download and then tap "Download" to export all your content right to your device.


2. USB Drive: For a more tangible backup, head to 'USB Drive', select all your desired albums, and order a USB hard drive containing all of your memorable moments.

Managing Your Account and Memories: Your memories are important, and so is your privacy. If you ever decide you want to erase your traces you have two options:

1. Selective Removal: You can choose specific videos and photos to remove from your Albums.


2. Full Account Deletion: If you decide to bid farewell to iMemories, email us at service@imemories.com to request account deletion. Your videos, photos, and account details will be erased. Your moments, your control, always with iMemories.

Other Information about this Policy

Important Notice to Non-U.S. Residents

The Websites, the Apps, the Services and their servers are operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us maybe transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use any of Website, App and/or Services, you consent to any transfer and processing of your personal information in accordance with this Privacy Policy and you do so at your own risk.

DO NOT TRACK

As discussed above, third parties such as analytics providers may collect information about your online activities over time and across different websites when you access or use the Websites, the Apps or the Services. Currently, various browsers offer a “Do Not Track” option, but there is no standard for commercial websites. At this time, we do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

Your California Privacy Rights

Under California law, a California resident with whom we have an established relationship has the right to request certain information with respect to the types of personal information the company has shared with third parties for their direct marketing purposes, if any, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. All requests for such information must be in sent by email to privacy@iMemories.com.

Your Nevada Privacy Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties. You can exercise this right by contacting us at privacy@iMemories.comwith the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A.

Children

We do not knowingly collect, receive, maintain, or use personal information from children under 18 years of age, and no part of any of the Website, App and/or the Services is directed to children under the age of 18. If you are under the age of 18, please do not provide any personal information through the Websites, Apps and/or the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children to never provide any personal information on the Websites, Apps, the Services, or any other web site without their permission. The Websites, the Apps and the Services may, from time to time, contain links to external websites.
